This section states, “If County has agreed by separate contract to require Contractor to name another party as an additional insured, Contractor shall add said party as an additional insured to the commercial general liability policy by ISO Endorsement CG 20 38. Contractor shall require its subcontractors performing work under this Agreement to add the County and any other party that the County has agreed by separate contract to require Contractor to name as an additional insured to their Commercial General Liability policy as an additional insured by ISO Endorsement CG 20 38. All commercial general liability policies shall provide a waiver of subrogation in favor of the County and any other party required by this Agreement to be named as an additional insured. Could the County clarify why and how a Contractor would be able to meet this requirement? Contractors wouldn’t be involved with the County’s separate contracts that would have this type of requirement and as such it is putting undue financial liability onto the Contractor. - Oct 11 2023 at 2:05 PMCounty of Volusia
From time to time, the county may be required to name other parties as additional insured that we currently do not have a contract with. As a result, we have to have the ability to require our contractors to add a party as an additional insured.
